Acceptance of Terms

Welcome to SigmaSlides. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and SigmaSlides ("we", "us", or "our"). We reserve the right to modify these Terms at any time. We will provide reasonable notice of any material changes via email or a prominent notice on the platform. Your continued use of the platform following the effective date of any changes constitutes acceptance of those changes.

Description of Services

SigmaSlides is an AI-powered platform designed to support Lean Six Sigma professionals and business leaders. Our services include:

• AI-Powered Template Generation: Create customised Lean Six Sigma templates, presentations, and process improvement documentation based on your inputs and requirements.
• Executive-Ready Slide Packs: Generate board-level presentations from case studies and project data, structured for executive decision-making.
• Template Library: Access pre-built templates covering DMAIC, Kaizen, Value Stream Mapping, and other Lean Six Sigma methodologies.
• AI Coaching: Receive strategic guidance and recommendations for process improvement challenges.
• Downloadable Content: Export and download generated templates, presentations, and reports in various formats.

We continuously update and improve our services. Features may change, and new capabilities may be added over time.

User Accounts

Registration Requirements

To access SigmaSlides, you must create an account by providing accurate and complete information, including your name, email address, and organisation details. You agree to keep this information current and accurate.

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use or security breach
• Ensuring that your use of the platform complies with these Terms

You may not share your account credentials or allow others to access your account. Accounts are intended for individual use and may not be used by multiple people unless specifically authorised under an enterprise plan.

Permitted Use

You agree to use SigmaSlides only for lawful purposes and in accordance with these Terms. You may not:

• Use the platform in any way that violates applicable laws or regulations
• Misuse AI features by submitting harmful, offensive, or illegal content
• Attempt to reverse engineer, decompile, or extract source code from the platform
• Use automated tools (bots, scrapers) to access or extract data without permission
• Interfere with or disrupt the platform's operation or servers
• Impersonate another person or entity, or falsely claim affiliation
• Upload viruses, malware, or other malicious code
• Resell, redistribute, or commercialise the platform or its content without authorisation

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including suspending or terminating accounts.

Intellectual Property

SigmaSlides Ownership

All rights, title, and interest in the SigmaSlides platform, including its software, design, branding, templates, and underlying technology, are owned by SigmaSlides. You may not copy, modify, distribute, or create derivative works without our express written permission.

User Content Ownership

You retain ownership of the content you create or submit to the platform, including:

• Project inputs, prompts, and descriptions you provide
• Files you upload for processing
• Content you generate using our AI tools

License to SigmaSlides

By submitting content to the platform, you grant SigmaSlides a limited, non-exclusive, royalty-free licence to process, store, and use your content solely for the purpose of delivering the services you request, improving the platform, and providing customer support. We do not use your content for unrelated commercial purposes or share it with third parties without your consent, except as described in our Privacy Policy.

AI Output Disclaimer

SigmaSlides uses artificial intelligence to generate templates, presentations, and guidance. While we strive to provide accurate and relevant outputs, you acknowledge and agree that:

• AI-Generated Content is Guidance: Outputs are suggestions and recommendations, not professional advice. You should review, validate, and customise all AI-generated content before use.
• No Guarantee of Accuracy: We do not guarantee the accuracy, completeness, or suitability of AI outputs for any specific purpose.
• User Responsibility: You are solely responsible for validating and using AI-generated content. We are not liable for decisions made based on AI outputs.
• Professional Judgement Required: AI outputs should supplement, not replace, professional expertise and judgement in process improvement, business strategy, and decision-making.

Subscription, Trials & Payments

Free Trial Terms

We may offer free trials to new users. Free trial access is limited to the features and duration specified at sign-up. We reserve the right to modify or discontinue free trial offerings at any time.

Billing and Payments

Paid subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. By subscribing, you authorise us to charge your payment method for the applicable fees.

• Automatic Renewal: Subscriptions automatically renew unless you cancel before the renewal date.
• Price Changes: We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance.
• Refunds: Fees are generally non-refundable, except where required by law. If a service fails to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a remedy, which may include a refund, repair, or resupply of the service.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. You will retain access to paid features until that time.

AI Coaching Credits

Each plan includes a monthly allowance of AI coaching credits, and one credit covers one AI action whichever feature it comes from. The allowances are 10 credits per month on the Free plan, 100 on Premium, 250 on Professional, and 400 on Consultant.

Credits refill on a monthly cycle, whether you are billed monthly or annually, and reset to the full allowance of the plan you hold at the start of each cycle. Unused credits do not roll over into the next cycle.

Changing Plans Mid-Cycle

When you change plans part-way through a monthly cycle, the credits you have already used remain counted and your new plan's allowance replaces the previous allowance for the remainder of that cycle. Your balance for the rest of the cycle is therefore the new plan's allowance minus the credits you have already used, and not the new allowance added to any credits you had left.

For example, if you use all 100 credits included with Premium and then upgrade to Professional (250 credits), 150 credits remain available to you for the rest of that cycle.

Charges When You Change Plans

Any charge or proration that applies when you change plans is calculated by Stripe, our payment processor, and is shown to you at checkout; the amount displayed at checkout is the amount that applies. Your new plan and its credit allowance take effect once that payment is confirmed.

Service Availability

We strive to provide reliable, uninterrupted access to SigmaSlides. However, you acknowledge that:

• No Guarantee of Availability: We do not guarantee that the platform will be available at all times or free from errors, delays, or interruptions.
• Maintenance and Updates: We may perform scheduled or emergency maintenance that temporarily limits access to the platform.
• Right to Modify Features: We reserve the right to modify, suspend, or discontinue any feature or service at any time. Where reasonably practicable, we will provide advance notice of significant changes or discontinuations.

We are not liable for any loss, damage, or inconvenience caused by service interruptions or unavailability.

Termination

We reserve the right to suspend or terminate your account and access to the platform at any time, with reasonable notice except in urgent circumstances, if:

• You violate these Terms of Service
• Your account is used for fraudulent, harmful, or illegal activities
• Payment obligations are not met
• We determine, in our sole discretion, that termination is necessary to protect the platform or other users

Upon termination, your right to access and use the platform will immediately cease. We may delete your account data in accordance with our data retention policies.

Limitation of Liability

To the fullest extent permitted by law, SigmaSlides and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Service interruptions or errors
• Reliance on AI-generated content or recommendations
• Unauthorised access to or use of your account

In no event shall our total liability exceed the amount you paid to SigmaSlides in the 12 months preceding the claim.

Some jurisdictions do not allow limitations on liability, so the above limitations may not apply to you.

Nothing in these Terms excludes, restricts, or modifies any statutory rights, guarantees, or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable laws that cannot be excluded. Where any statutory right or guarantee applies and our liability is limited, that liability is limited to, at our option, resupplying the services or paying the cost of having the services resupplied.

Indemnification

You agree to indemnify, defend, and hold harmless SigmaSlides and its affiliates, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your use of the platform
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you submit or generate using the platform

Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of New South Wales.
